This consultation seeks views on HSE’s proposals to consolidate and modernise the explosives legislative framework in GB. The new regulatory structures will, where practicable, simplify the current legislative arrangements for explosives making the requirements easier to understand. As part of this work, HSE is also seeking views on the proposal to withdraw the Approved code of practice to the Manufacture and storage of Explosives Regulations 2005 (MSER). The consolidation is part of the sector specific consolidations recommended by Professor Löfstedt’s independent review of health and safety legislation ‘Reclaiming health and safety for all’ which are to be delivered by April 2015.

The new Explosives Regulations will consolidate elements of one Act, ten pieces of secondary legislation and fifteen exemption certificates. The proposed consolidation does not dilute or substantially alter existing health, safety and security requirements. The proposed regulations aim to improve ease of use for businesses. Additionally, where opportunities to reduce burdens on business have been identified or where evidence suggests greater control of potential hazards is required, new requirements have been proposed. We are also consulting on the proposal to consolidate and modernise the supporting guidance framework in light of any changes to the legislation.
